BOOKHOSPITALITY.COM PURCHASE TERMS AND CONDITIONS

These are the terms and conditions on which Bookhospitality.com provides Hospitality Packages at Events. Please read them carefully before you submit your order to us. They tell you who we are, how we will supply Hospitality Packages to you, how you or we may end the contract, what to do if there is a problem and other important information. Capitalised terms shall have the meanings set out in Section 10. Please note, Hospitality Packages cannot be exchanged or refunded after purchase, save as set out in these terms and conditions.

ABOUT US

1.1         www.bookhospitality.com is a Hospitality Package booking website operated by Zest Sports Group Limited.

1.2         Company details. ZEST SPORTS GROUP LIMITED (company number 10873082) (we and us) is a company registered in England and Wales and our registered office and main trading address is at 13 The Causeway, Teddington, London, United Kingdom, TW11 0JR. Our VAT number is 298459924. We operate the website www.bookhospitality.com 

1.3         Contacting us. To contact us email our customer service team on info@bookhospitality.com.  Please use these contact details to tell us of any problems.

OUR CONTRACT WITH YOU

2.1         Our contract. These terms and conditions (Terms) together with the Order Confirmation,  the Venue Terms and Conditions and the Event Terms and Conditions which you will be required to accept via a tick box on the Website apply to the order by you and supply of the Hospitality Package by us to you (Contract). They apply to the exclusion of any other terms that you seek to impose or incorporate, or which are implied by trade, custom, practice or course of dealing. In the event of any inconsistency between these Terms and the Venue Terms and Conditions or the Event Terms and Conditions, the Venue Terms and Conditions or the Event Terms and Conditions as the case may be shall prevail.

2.2         How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the postal or email address you provided on your order.

2.3         Your copy. You should print a copy of these Terms or save them to your computer for future reference.

2.4         Your order number. We will assign an order number to your order and tell you what it is when we send you your Order Confirmation. It will help us if you can tell us the order number whenever you contact us about your order.

BOOKINGS, ORDER CONFIRMATION

3.1         Placing your order. Please follow the onscreen prompts to place an order for Hospitality Packages. You may only submit an order using the method set out on the Website. Each order is an offer by you to buy the Hospitality Package selected by you on the Website.  You confirm that you are over the age of 18.

3.2         Correcting input errors. Our order process allows you to check and amend any errors before submitting your order to us. Please check the order carefully before confirming it. You are responsible for ensuring that your order is complete and accurate.

3.3         Accepting your order. Our acceptance of your order takes place when we send an email to you to accept it (Order Confirmation), at which point and on which date (Commencement Date) the Contract between you and us will come into existence. The Contract will relate only to those Hospitality Packages confirmed in the Order Confirmation. All Hospitality Packages are sold subject to availability and to credit or debit card verification and other security checks.

3.4         If we cannot accept your order. If we are unable to supply you with the Hospitality Packages for any reason, we will inform you of this by email and we will not process your order. If you have already paid, we will refund you the full amount.

3.5         Checking the Order Confirmation. It is your responsibility to check the Order Confirmation is complete and accurate and to contact us immediately if anything is wrong.

OUR SERVICES

4.1         Compliance with specification. Subject to our right to amend the specification (see Section 7.2) we will supply Hospitality Packages to you in accordance with the specification appearing on the Website at the date of your order in all material respects.

4.2         Reasonable care and skill. We warrant to you that the Hospitality Packages will be provided using reasonable care and skill.

4.3         Time for performance. We will use reasonable endeavours to meet any performance dates specified in the Order Confirmation. However, please note that advertised start times may be subject to change and door opening and closing times are not indicative of when the event will actually start.  We will attempt to accommodate latecomers but can make no guarantees as to entry.

4.4         Event documentation (which may include the Order Confirmation, itineraries, maps , tickets, passes and other final details with respect to any Event or Booking) will (if you selected that option at the checkout) normally be despatched to you at the address specified on the Order Confirmation (which must match the address to which the card used to make the Booking is registered) approximately 30 days before the Event or as soon as practicable for late Bookings. For some deliveries, a signature may be required.  Otherwise, event documentation will be sent to you at the email address which you registered when you made the Booking. No Event documentation will be sent to you until payment has been received in full.

4.5         Please note that Photo ID matching the name in which the Booking has been made, together with your event documentation will be required to enable entry to the Event. 

4.6         We reserve the right not to issue duplicates for any lost Event documentation. Replacement documents can only be collected by you upon arrival at the Venue on the day of the Event.

PRIVACY POLICY

Your details and those of your party if provided by you at the time of the Booking will be kept by us in order to process the Booking and, for the purposes set out in our Privacy Statement which can be found here https://bookhospitality.com/pages/purchase-terms-conditions

PAYMENT TERMS

6.1         The price is the price quoted on our Website at the time you place your order. Prices are broken down on our Website so that the handling or delivery fee is separate from the cost of the Hospitality Package.  All prices stated on our Website are inclusive of any value added tax unless specifically otherwise stated. We take all reasonable care to ensure that the price is correct. However, please see Section 6.2 for what happens if we discover an error in the price of the Hospitality Package you order.

6.2         It is always possible that, despite our best efforts, some of the Hospitality Packages we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we are unable to contact you, you agree that we may treat the Contract as cancelled and issue you with a full refund.  If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.

6.3         No order will be accepted until we have received full payment.

6.4         Payment by credit card may incur a surcharge.

VARIATION, CANCELLATION AND REFUNDS

7.1         If you wish to vary any details of the Booking, you must notify us in writing as soon as possible. If we confirm our acceptance of any requested changes, we reserve the right to make agreed additional charges (which will be paid by you).

7.2         Whilst every reasonable effort will be made to ensure that Hospitality Packages are provided in accordance with the Order Confirmation, we reserve the right to make any changes which do not materially affect the quality of the Hospitality Packages. If we have to make any material changes (for example because the organiser of the Event and/or the Venue have made alterations to the Event) we will notify you. We will seek to offer you alternative arrangements as close to the original as is reasonably possible in the circumstances. Where such alternative is not acceptable to you, we will refund to you the price paid for the Booking.

7.3         Please note that by virtue of Regulation 28(i)(h) of the Consumer Contract Regulations 2013, contracts for catering or services related to leisure activities for a specific date or period of performance are exempt from the general right of consumers to cancel online contracts within fourteen (14) days.

7.4         You can ask us to rectify the situation or get some money back if we do not provide our services with reasonable care and skill.  If we are not at fault you can still end the Contract before it is completed. If you cancel more than (8) weeks before the Event date then, subject to the following sentence, we will refund 50% of the Fees and if you cancel less than (8) weeks before the Event date, there will be no refund.  We will however use reasonable efforts to sell the Hospitality Packages you have cancelled and, if successful, will refund to you an amount equal to the price received (which we cannot guarantee will be the same as the Fees you have paid) , less any refund already paid to you and less reasonable handling and administrative charges and reasonable compensation for the net costs we will incur as a result of your ending the Contract.. If you wish to end the Contract in these circumstances, please contact us at info@bookhospitality.com to let us know. The Contract will end immediately

7.5         We may need certain information from you so that we can process and implement your Booking. We may contact you asking for this information. If you do not give us this information within a reasonable time of us asking for it, or you give us incomplete or incorrect information, we may end the Contract. We will not be responsible for failure to provide a Hospitality Package if this is caused by you not giving us this information within a reasonable time of us asking for it.

7.6         If for any reason beyond our reasonable control, the Event and/or the Hospitality Packages are cancelled, rescheduled or disrupted in any way, we will not be liable to you or be deemed to be in breach of contract by reason of any delay in performing, or failure to perform any of our contractual obligations. If the Event is rescheduled you will be entitled to the same Hospitality Package at the rescheduled Event or a refund.  If you require a refund you must let us know within 10 days of notification of the rescheduled Event.

7.7         Personal arrangements including travel and accommodation which have been arranged by you are at your own risk.

7.8         We may withdraw the Hospitality Package. If we do so we will write to you as soon as possible in advance of the scheduled date of the Event and we will refund sums you have paid.

7.9         Please note that in the event that the Venue Terms and Conditions or the Event Terms and Conditions set out a different cancellation or refund policy, they will prevail over the general policy set out in this Clause. You will have ticked a box on our Website to accept these at the point you place your order.

7.10       Refunds requests are to be made to info@bookhospitality.com .  Refunds will be made to the card used for making the Booking.

RULES, FILMING AND INTELLECTUAL PROPERTY

8.1         You will (and will ensure that all those in your party) will at all times be suitably behaved and will comply with the rules, regulations, policies and procedures of us and/or the operators of the Venue in connection with the Event, including (for example) any no smoking policy,dress code, security checks, policy on refusal of admission, laser pens, dogs, mobile phones, food and drink, . You will indemnify us from and against all and any claims, costs, damages and judgments arising from breach of this clause. We reserve the right in our absolute discretion to refuse admission or to remove any person who is in breach of these, terms and conditions, appears to be under the influence of prohibited substances or alcohol or whose behaviour is deemed likely to cause a nuisance or who is not suitably dressed or any person without the appropriate Event documentation.

8.2         Any views or comments expressed by speakers at the Event are not necessarily shared by us and we accept no responsibility or liability for them.

8.3         You consent (and will procure that all those in your party consent) to being photographed at the Event, to filming and sound recording of the Event and to the use of such photographs and/or recordings in any marketing or promotional materials in connection with the Event, on our website and in any broadcast or publication in any territory in the world.

8.4         You will not (and will procure that all those in your party will not) film or record any part of the Event.

8.5         You acknowledge and agree that we and our licensors own the copyright and other intellectual property rights in all Event-related materials and trademarks used in connection with the Event. You will not (and will procure that those in your party will not) use or reproduce any such materials or trademarks (or anything confusingly similar) without our prior written consent.

LIMITATION

9.1         We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.

9.2         We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the Hospitality Packages including the right to receive services which are: as described and match information we provided to you; of satisfactory quality; fit for any particular purpose made known to us; supplied with reasonable skill and care.

9.3         We are not liable for business losses. We only supply Hospitality Packages for domestic and private use. If you use them for any commercial or business purpose we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

OTHER IMPORTANT TERMS

10.1       You will procure that you and all persons in your party comply fully with these Terms and with the Venue Terms and Conditions.

10.2       The rights granted to you are personal to you and may not be resold, transferred or assigned to any third party without our prior written consent. This is in addition to any resale policy of our Event Partner which will have been drawn to your attention on our Website at the time you make your Booking. Any attempt at resale or transfer may result in confiscation of the Hospitality Package and refusal of admittance/ejection from the Venue.

10.3       You will not sell the benefit of any Booking on the wholesale or trade market without our prior written consent. You may not transfer the benefit of a Booking for use as a competition prize or other promotional use.

10.4       No waiver by us of any breach of these Terms by you will be considered as a waiver of any subsequent breach of the same or any other provision.

10.5       If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Terms and the remainder of the provision in question will not be affected.

10.6       No amendment or variation to these Terms will be binding on us unless agreed in writing by our duly authorised representative.

10.7       This Contract is between you and us. No other person shall have any right to enforce this Contract.

10.8       These Terms will be governed by and construed in accordance with laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the courts of England and Wales.

DEFINITIONS

11.1       "Booking" means an order for a Hospitality Package at the Event at which has been placed via our Website www.bookhospitality.com and in respect of which we have sent you an Order Confirmation.

11.2       "Event" means the event which is the subject of the Booking.

11.3       “Event Partner” means the relevant Event organiser, promoter, governing body, agents, teams, venues and others involved in the staging of the Event.

11.4       “Event Terms and Conditions” means the terms and conditions applicable to the Event

11.5       “Fees” means the price quoted on our Website at the time you place your order for your chosen Hospitality Package.

11.6       “Hospitality Package” means a hospitality pack relating to the Event which has been ordered by you via the Website.

11.7       “Order Confirmation” means a written order confirmation issued by us (which may be via email) as described in Section 3.3.

11.8       "Terms" means these booking terms and conditions.

11.9       “Venue” means the location where the Event is intended to be held.

11.10    “Venue Terms and Conditions” means the terms and conditions applicable to the Venue.

11.11    “Website” means our website www.bookhospitality.com.
